Re: Chapter Eight-D: Tibbs Follows Stuff Up
Lieutenant Kikuyu
I think about 90% of that is delusion and somewhat lacking in evidence, but the key issue from your perspective would seem to be quite altruistic.
How about this for a proposal.
You sign this document that states that these negotiations are private and will not be disclosed without our prior written consent. If you get what you want, you can tell your "other parties" that the deals has been struck; and if it fails you tell them that there was no deal. But the discussions are kept out of the public domain.
But be aware that the public purse is not bottomless and the Queen, on the open market, and as she stands, is not worth face-value on the shares by a large margin. Ngora has what chance of success in a hearing in the Admiralty court? That will diminish her cut's potential value.
But at least you have agreed that you are for sale: All we need do now is agree the price!

Smiles at the returned gambit from Yvonne Kikuyu.
"Great. Well any barrister can build on the 10% of agreed facts to date and already the 'balance of probability' starts to swing in my favour.
I have signed these affadavits to substantiate my power of attorney which I have always insisted will be discreet and covert enough not to ruffle any feathers. Nothing I or you say is in the public domain.
The simple truth is if we cannot come to any compromise then the court sits and either way my own position is unaffected.
I own a quarter of the ship now and in ninety days will still own a quarter of the ship. The navy owns nothing of the ship now and in ninety days will own even less.
However though you have no physical stake in the ship, the navy does retain some personal interest. And if you want to protect those interests it is to your advantage to negotiate rather than see those interests exposed by the court.
It is a matter of public record that Cloud Bank offered to purchase the naval held shares for $6Mcr. I know from Charlie Maputo that QoTB Holdings secured them for more. Much more, though not the $12Mcr value I equally hold.
The shareholders have agreed to continue litigation through Rigsby & Sood over a claim for negligence and damages whilst the craft was restrained at the port under your orders. The court has set precedence with the award of $4Mcr. The salvage and storage costs are contested. So not only may you pay out the purchase price of the shares plus compensation back to the Ngora Kole, you also stand to lose out on further financial costs. A compromise solution can settle that also.
What value does the navy put on the court case?
Your former captain, Indrani Carter, subpoenaed to appear at a military tribunal to disclose why and how she seized the Queen. A commissioned officer discharged to take up the resident Captains seat in that very vessel. How will Ngora Kole react to know the person who apprehended her father, was responsible for him being held on remand and who ultimately died in prison, sits in his position. Voted overwhelming into that seat by the naval support. Would she damage her rank and social standing by falsifying evidence? Risk demotion? She would become a pariah in the eyes of all. Who would she incriminate as giving the orders. Who sold her share at a reduced price?.What cargo did the government agents put on board and how was Hebden Cull given immunity from prosecution. If he was only around to tell?
I am sure your Admirals too prefer anonymity than being subpoenaed under public scrutiny in a witch hunt. You could avoid that and any personal comebacks. I understand your position. I truly do. As a former law enforcer I exposed corruption but all I got for it was bummed out of service and being cryogenically frozen. The thaw out burnt my skin all over. See they compensated me with this subdermal sheen. It has its benefits, a bionic cock means the ladies always think I am so pleased to see them, though my offspring producing days are gone. What repercussions are done in the navy now? Keel hauling and hanging from the mizzen mast are history. Maybe a dip in an acid bath or simply blown out the airlock?
I digress again. The navy have a choice to retain interest in the vessel or having relinquished all and every hold upon the Queen, you wave us off with best wishes knowing we take with us the enigmas of Saffa's FTL theories. And with a new Captain in place. And probably new admirals too, and a new pretty face behind this desk.
How fast can your particle accelerator go? Not fast enough should Saffa produce his Eureka moment. I told Ngora Kole that the knowledge of physics expanded when the apple dropped on Newton's head. Now the wind blows the tree again and we get to choose whose hand the Saffa apple falls in.
So what deal can you put on the table?"

I'm sorry, without this document being signed, I'm not permitted to discuss the matter further.
And she pushes the tablet with the information towards you.
Would you care for a drink as you read? Or perhaps you would prefer to have you lawyer scrutinise it first? Shall we meet again in a few days? There's no rush.

"You are dealing with me and me alone. If you cannot come to an agreement the court sits. We should both be disappointed if it went that far.
The pressure of time to find a solution before the appeal opens is upon you. The ninety day moratorium to prepare is already half reduced as both Maputo and Kole have all their papers in order, the suppositions, arguments, legal precedence, records from the Queens archives. Reopened investigations following the discovery of the deceased Jusu Saffa have also uncovered his last years movements and who he engaged with.
These files reside upon the High Court judges desk now, being toothcombed by legal eagles as they fine tune what may be admitted as evidence. Judges now only wait for the Admiralty to consider their defence. The clock is ticking.
One issue you face is that a main instigator of the Queen seizure is no longer a navy officer. Capt Indrani resigned her commission and therefore does not need to speak to Admiralty officers before she testifies against the navy procedures. Indeed as a witness for the prosecution she cannot converse with her former employees. So you will only get to cross examine her testimony ... not help her prepare what to say. Though if you have discreet questions or advice that might be whispered as 'sweet nothings' into her ear while she serves on my ship, perhaps as your trusted confident I could converse with her. Hypothetically of course.
With the court appeal in place, the Queen, or at least Indrani may be remanded to remain on the ground until her evidence is presented. Her subpeona is being scripted now at the utmost importance. That is a delay for me also as I need the best people in place to undertake the Queen's mission and do not wish to fly without her. As she was the navy's 'preferred candidate' for the Captaincy I assume you share the same conviction.
Now consider carefully what deal you can put on the table. What can I pacify those I represent with?"
"Well these affadavits of mine mean that the parties involved will accept any compromise solution that I deem suitable. All parties should prefer to keep things out of court, not just for financial reasons. I will sign these and you can agree to those." Tibbs signs the formalities if it helps the Lieutenant negotiate for the Admiralty. She has an affadavit passed to her which basically authorises him to present any solution agreed to the other litigants and to represent the navy interest while the share issue is contested. You sign this document that states that these negotiations are private and will not be disclosed without our prior written consent. If you get what you want, you can tell your "other parties" that the deals has been struck; and if it fails you tell them that there was no deal. But the discussions are kept out of the public domain

Re: Chapter Eight-D: Tibbs Follows Stuff Up
Bah
You say things that may come to pass as if they are true now! Lets negotiate on the basis of reality now, not what might come to light in the next three months.
As you have signed, you are now subject to the Defence of the Belt regulations, 203 as amended by subsequent legislation. We propose that the QotB corporation buy out the remaining shares in the Queen of the Belt for Cr 700,000 each and that the current crew contract to the QotB Corp as a ship company acting as a licenced courier. As such, the ship may undertake such business as it deems fit, but will make such investigations and reports as directed by that company or by the Navy of the Belt. All legal cases regarding ownership will be dropped. The Queen will be refitted at the QotB's Corps expense to enable this business to be conducted, subject to the exigencies of the missions to be undertaken.
As a sweetner, you will personally become the CFO of QotB Corp and Supercargo aboard - paid as a Lieutenant of the Belter Navy.
As to Ngora's claim that her father was not a Pirate and that her Father was not guilty, You should look at the history of Mr Celisse - Not that which he so neatly promulgates, but that where he spent his first 8 years aboard the Wind of Change. And also contemplate his role in the Starflight Conspiracy and his actions during the Taktsang Pirate's Insurrection. He was a Criminal, Mr O'Hare. First, Foremost and Always.

He listens to what the Lieutenant of the navy bureau says and picks up on the revelations she gives away by what she doesn't say.
He smiles again. "We should really have gone for that walk. The fresh air might have blown those cobwebs away from our heads.
A drink. Why not. A toast to co-operation, comradeship." He does have a bottle of Hotel Paradiso red, which seems to be a permanent inventory item in his briefcase. He pops the cork and pours into a glass or nearby china cup. "Can you drink while on duty
Lieutenant? Well, civilianship still has its merits.
"
Tibbs muses as his eyes flicker, as if he is making mental calculations and connotations.
"You are correct. The Sparks public purse is not the fattened goose it alludes to be. And that could also prove problematic should the judges find in favour of Ngora Kole.
Now that relational elements are clearer. It is apparent that this young lady is your chief agitator. I have spoken at length with her previously regarding the risks and rewards of pursuing certain goals she has set. Perhaps she has inherited some reckless determination from her father. I have no doubts that Jojo Celisse is all you say and more. The girl would be an asset but I fear she would not acquiesce to the planned vision.
'Chucky Muppet'? Is he an asset to the vision? I will reach out again to them and present various options. Would you agree to compensate Ngora Kole to the value of $700kcr per disputed share?"
He has a few more discussions in his mind regarding the proposal but wants to address certain points in order.

We would much prefer to pay less, but if this gets the issues resolved and out of the papers, that seems worth the additional expense. The position is potentially worth less because of the chance of losing...but the argument that compensation is needed could be heard. A rapid decision would be appreciated.

"Well why don't we agree to smooth every difficult terrain. Avoid this unnecessary claim and grease the wheels of the Sood litigation for negligence and storage damage.
Offer me a straight $12Mcr for Ngora Kole and I will advocate the stakeholders meet you in the negligence pursuit for $3Mcr.
No claims, no blames, no testimonials, no inquests.
I can give the good news confidentially to our other partner."
He passes details over of an account from which he can manage and distribute the funds without a thread back to the Admiralty. (Swiss-Panama Stellar Alliance)

Perhaps you would like to take the offer back to your friends? Are you, personally, amenable to the terms offered?
Re: Chapter Eight-D: Tibbs Follows Stuff Up
Tiberius has Advocate 1 from the team package skills list. (Diplomat 0)
"There is much to think about and a deal to work around. I will put your final offer of settlement to Ngora and consider the other issues and come back with any way we can progress those as a whole."

Sensing preliminary discussions are over for now and armed with a potential offer to put to the interested parties, he bids the officer farewell and exits the Admiralty compounds.
Still too many questions, mostly unanswered, certainly too many variables. He feels like one of those vaudeville plate spinners running between poles and wibbly-wobbly saucers needing to be kept in motion. A crash or two might actually help solve a few issues.
Crash. Tansu and private matters at the Touchdown Embassy. Good for her now to get earthside, especially after the burglary and incident with her immediate boss. Tibbs revisits Sabbana & Sabbana and muses on 'crash 2' with Maputo.

Joey Sabbana isn't immediately available and Tiberius has to cool his heals in the lobby for 30 minutes until, eventually, Joey and a client arrive - The client being passed off to the receptionist and Joey turning to Tiberius
Mr O'Hare - you are slightly earlier than I expected. I'm afraid the contract isn't quite finalised - my colleague has drawn up the draft but I still need to confirm that it doesn't have any typing error or legal loophole. Are you wanting to wait? You may find it more convenient to return in an hour.
He looks at Tiberius...
Unless there is some other business that you need to transact?

"Oh I am quite happy to return at close of business if that is more convenient. Though another matter has been presented which may demand your thought and attention.
It has been put to me via QoTB Holdings that an offer of $700kcr per share is being made to stakeholders to sell their interest in the Queen ship. The bid is 40% higher than Cloud Bank's initial offer presented on Monday. Indeed Amadou & Moussa from the bank have already liquidated their options.
So you may like to consider that for the Cull estate you manage. Of the recent murder case suspect you represent. It might also be prudent for them to step back from all interest in the ship as other personal issues take preference.
It looks like the new corporation wishes to take ownership and wipe the slate clean of all historical ties to the Celisse era and the smuggling notoriety. Anyway. Consider the offer."

Now that is interesting. As I stated earlier, I cannot liquidate the estate - indeed I can hardly manage it effectively because of the constraints placed upon it. But my other clients may be interested - if only to fund their defence! I'll be happy to take the offer to them. But you should beware of that Mr Maputo - I'm not sure he is not trying some deal or other. I find him somewhat shifty, if truth be told.
And if you'll excuse me, I shall finish the review of the papers so they will be prepared for your return.

Chills out in some Internet Cafe type place until close of business. He checks media for updates on various articles such as the bomb alert, Ngora Kole's legal blogs, news on the search for Noor and local police matters. At some point a press release was expected regarding the investigators into Starflight being stonewalled access to enquiry details.
He picks up the stamped legal documents and returns to his hotel suite for the evening.

There are three things that occur:
- Tansu has been ringing you
- Joey Sabbana has a preliminary answer from Ngora...Maybe. But she wants to talk.
- there appears to be electric scooter drag racing being staged in the Grand Plaza and long the road to the station...The police seem to be represented by a patrol car that is parked in an alley and pointedly not interfering as they are seriously outnumbered.

Focuses on number two issue. Ngora Kole. So I had her agreement on principle to approach the Admiralty with a view to agree an out of court settlement over the share ownership issue.
I have a tentative offer to present but have not done so yet. So her 'wanting to talk' indicates either second thoughts or another issue.
He gives her a ring.

In typical style, you just get voice mail - but fortunately she phones back quite quickly.
So they want to disentangle themselves from their mess, but aren't willing to admit their mess. They just want to pay in cash and have the whole thing go away. I am very disappointed. Not surprised, but very disappointed.
So does the deal they offer actually mean I can't continue to try and clear Dad's name?

"So good of you to return my call Ngora . So my preliminary discussions have borne some positive avenues to explore. They offer some recompense for your troubles which I think you and the newly wed Mr Kole Should consider thoughtfully. I can't go into the nitty gritty of finer details over the phone so my recommendation is to meet you both before I discuss any further with our fellow disputee."
Tibbs offers to go around to her residence that evening.

Unless there is some definite, urgent time constraint, I'd suggest that we meet tomorrow as I have plans for tonight. Joey's description of the offer wasn't quite what I'd hoped - but if you have ideas for improvement then I'd like to discuss those. You should also know that I was planning to return home the day after tomorrow, so after that communications will have to be undertaken remotely. I could potentially extend my stay until the 9th, but no longer.
